These Terms of Service govern access to jwearstudio.com and purchases from Jwear Studio. By using the site or placing an order, you agree to these terms and the policies referenced below, subject to mandatory law.

1. Store operator

Jwear Studio operates from Distelweg, 1314 LW Almere, Netherlands. Contact: info@jwearstudio.com.

2. Eligibility and lawful use

You must have legal capacity to enter a purchase or use the site with appropriate authorization. You may not use the site for unlawful, fraudulent, abusive, infringing, or security-disruptive activity.

3. Product information

We aim to describe products, materials, colors, sizing, and availability accurately. Screens and lighting can affect color appearance. Measurements and fit guidance are informational; comfort and fit vary by body and product. We may correct errors and update information.

4. Prices, taxes, and currency

Prices and available currencies are shown on the site. Taxes, shipping, duties, or import charges may apply as shown at checkout or imposed by authorities. A displayed error does not require us to supply a product at an obviously incorrect price where law permits correction.

5. Orders and acceptance

Submitting checkout is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean final acceptance. We may reject or cancel an order for inventory, payment, fraud, shipping, pricing, legal, or technical reasons and will provide an appropriate refund when payment was captured.

6. Payment

Available methods appear at checkout and are processed by payment providers. You must provide accurate billing information and be authorized to use the method. Never email complete card details or passwords.

7. Cancellation

The current rule allows cancellation until fulfillment. Contact us immediately; cancellation or changes cannot be guaranteed after preparation begins. Mandatory withdrawal rights remain unaffected where applicable.

8. Shipping and delivery

Shipping is governed by the Shipping Policy. Standard delivery is estimated at approximately 7–14 business days, but estimates are not guarantees. Customers are responsible for accurate delivery information and any applicable import charges not collected at checkout.

9. Returns and refunds

Eligible returns are governed by the Return and Refund Policy, including the current 14-day return window, condition requirements, hygiene considerations, exclusions, shipping costs, and refund process.

10. Accounts

If account features are available, you are responsible for accurate information, credential confidentiality, and activity under the account. Notify us if you suspect unauthorized access. We may restrict access to protect users or the service.

11. Intellectual property

The site’s branding, logos, text, graphics, photography, design, and other content are owned by or licensed to Jwear Studio and protected by applicable law. Limited personal browsing and shopping use does not grant rights to copy, resell, scrape, publish, or commercially exploit content.

12. Reviews and user content

If you submit a review, image, comment, or other content, you confirm you have the right to do so and that it is accurate, lawful, non-infringing, and not misleading. Where permitted by the submission feature, you grant us the rights reasonably needed to display, moderate, and use that content. We may remove content that violates these terms.

13. Third-party services and links

The site may use or link to payment, shipping, analytics, social, or other third-party services. Their own terms and privacy practices may apply. A link does not necessarily mean endorsement, and we are not responsible for third-party sites outside our control.

14. Prohibited conduct

You may not introduce malicious code, attempt unauthorized access, interfere with operation, harvest personal data, bypass security, misuse promotions, place fraudulent orders, infringe rights, or use automated systems in a way that burdens the service or violates law.

15. Disclaimers

Product and fit information is general and is not medical advice. Stop using a garment that causes pain, numbness, breathing difficulty, or significant irritation. To the maximum extent permitted by law, the site is provided without guarantees that it will always be uninterrupted or error-free. Mandatory consumer guarantees remain unaffected.

16. Limitation of liability

To the maximum extent permitted by law, Jwear Studio is not liable for indirect, incidental, special, or consequential losses arising from use of the site or products. Nothing limits liability that cannot lawfully be limited, including applicable rights for defective goods, fraud, or personal injury caused by negligence where such limitation is prohibited.

17. Indemnity

Where legally permitted, you are responsible for losses arising from your unlawful misuse of the site, violation of these terms, or infringement of another person’s rights.

18. Changes

We may update these terms for operational, legal, security, or service reasons. The date above identifies the current version. Changes apply as permitted by law and do not remove rights already accrued.

19. Severability and no waiver

If a provision is unenforceable, the remaining provisions continue to the extent possible. Failure to enforce a provision once does not waive the right to enforce it later.

20. Governing law and disputes

These terms are governed by applicable Dutch law, without depriving consumers of mandatory protections of their country of residence. Before formal action, contact us so we can try to resolve the issue. Consumers may also have access to competent courts or dispute-resolution bodies under applicable law.
